What rights do individuals have under LGPD?
LGPD grants extensive individual rights. Right to confirmation: individuals can confirm whether their data is being processed. Right to access: they can obtain a copy of their data. Right to correction: they can request correction of incomplete, inaccurate, or outdated information. Right to anonymization, blocking, or deletion: unnecessary, excessive, or unlawfully processed data can be anonymized or removed.
Right to portability: individuals can receive their data in structured format and transfer it to another service provider. Right to information about sharing: they can know which third parties have received their data. Right to revoke consent: they can withdraw consent at any time, with processing based on that consent ceasing.
Rights requests must be addressed through simplified procedures and responded to within reasonable timeframes (regulations specify details). Organizations cannot charge for responding to rights requests except in cases of excessive or unfounded requests. LGPD individual rights largely parallel GDPR-systems designed to handle GDPR rights requests can typically accommodate LGPD with minimal adaptation.
