Is CAN-SPAM the same as GDPR?

No. CAN-SPAM and GDPR are different regulations with different requirements. CAN-SPAM (US) allows unsolicited email with opt out. GDPR (EU) requires lawful basis before sending, often explicit consent.

CAN-SPAM is an opt out framework. GDPR is an opt in framework. Meeting CAN-SPAM requirements does not satisfy GDPR for EU recipients.

Know which regulations apply to your recipients and meet the stricter requirements when audiences overlap. EU recipients need GDPR compliance regardless of sender location.
